prosecution just need to prove the following

is he a public servant?
did he take a gift?

chiu have to understand that ministerial code of conduct is not a piece of legislation, it ish not enforceable in any court of law.

but penal code ish a piece of legislation enforceable by the sg courts passed by the parliment of singapore or it's predecessor legislative assembly or legislative chamber or watever it was called at that time.
